Terms and condition

1

General sales conditions

 
  1.1 The following general sales conditions are an integral part of all our sales contracts, even when orders are taken by phone, verbally, by fax, e-mail.
  1.2 Verbal or phone agreements preclude the right to protest in case of misinterpretation regarding the models and / or quantities.
  1.3 We reserve the right to change the terms of sale, informing the customers on this page of our site. Any new terms will be effective upon publication and will be applied to sales not yet defined. We therefore invite you to read the conditions before proceeding with a purchase.
     

2.

Orders

 
  2.1 Orders can be sent in writing, addressed to Barbaro Bersagli sas, Via Paderno, 31/B - 24068 Seriate (BG), or by e-mail at sales@barbarobersagli.it, or by fax at n. 035/303105.
  2.2 Orders can also be dictated to our answering service at no. 035/303105 (24 hours) or by telephone.
  2.3 In case of cancellation of orders, with the goods already in shipment or delivered, costs incurred for the preparation will be charged in addition to any shipping and return charges.
  2.4 Orders concerning customized products and / or realized on customer specifications cannot be canceled.
     

3.

Minimum order

 

  3.1 The minimum order is for pack, as shown in our catalog or as otherwise stated in the offer.
     

4.

Payments

 
  The following payment conditions are valid unless other arrangements already in force.
    4.1.1 Cash payments are not accepted.
4.1.2 The supplies will be made only on receipt of advance payment, made by bank transfer, upon confirmation of goods ready.
4.1.3 In case of goods collection near us, the goods will be delivered only upon notice of goods ready and against advance payment receipt.
    4.1.4 Bank fees will not be accepted.
       

5.

Deliveries

 

5.1

For goods in stock, the shipment is made within 2/3 working days.

 

5.2

Unless otherwise specified by customer in the order, the shipments are dispatched, in bulk, freight prepaid, with national carriers which we are operating with.
  5.3 Freight will be charged in the invoice.

 

5.4

Transport costs are calculated according to weight, destination, to the required services. Except in cases of obvious urgency, the courier is selected according to the least cost.
  5.5 Shipments are made at customer risk. Any damage caused by transport must be claimed to the carrier, at the time of delivery and motivated on the Transport Document.

 

5.6

The customer is required to examine the goods upon receipt, to exclude any shipping damage and to make sure that the goods are complete.
  5.7 In case of problems arising from the transport, the customer is not required to accept the material. Complaints must be briefly described on the transport document presented for signature by the courier and a copy must be sent to us to solve the problem and to ask for compensation to the courier.

 

 

 

6.

Consignement

     
  6.1 Consignement is made at the customer address, on working days only and normal daytime working hours.
  6.2 The days and timetables of weekly opening as well as closing periods must be specified in the order, or the costs for storage and / or attempted delivery will be charged.
  6.3 Additional services, charged at cost, may be expressly requested in the order:
    6.3.1 destination at an alternative site;
6.3.2 destination at a private home;
    6.3.3 telephone notice for direct agreements on delivery schedules;
    6.3.4 vehicle equipped with hydraulic side;
    6.3.5 courier warehouse storage;
    6.3.6 express delivery and/or urgent delivery.
  6.4 Delivery to the islands, smaller islands, the Venetian Lagoon, the uncomfortable locations are subject to special rates, as provided by the used transport company.
     

7.

Claims, right of withdrawal and goods returns

     
  7.1 Complaints and/or requests for withdrawal must be notified within 10 days of receipt of goods in writing, addressed to Barbaro Bersagli sas - Via Paderno, 31/B - 24068 Seriate (BG) or by fax to n. 035 303105 or via e-mail at sales@barbarobersagli.it.
  7.2 Outside those cases allowed by law, the return of the goods supplied, free of defects, occurs only in extraordinary cases, with the approval of Barbaro Bersagli (see also 2.3 and 2.4) points.
  7.3 In any case, any return of products must be previously agreed and authorized by Barbaro Bersagli sas that will confirm by letter, fax or e-mail stating the conditions and the delivery address.
  7.4 The products must be accompanied by a copy of the purchase Delivery Document and packed in original packaging or in suitable packaging. Barbaro Bersagli sas reserves the right to verify the quantity and the quality of returned goods
     

9.

Competent Court

     
  9.1 In case of dispute the place of jurisdiction is Milan.
     

10.

Customers data handling

    According to the Dgls 30 June 2003 n. 196 and EU General Regulations GDPR 2016/679, we inform that only the "personal and identification data" necessary for the fulfillment of the fiscal and commercial relationships, in fulfillment of legal obligations and for statistical purposes of production are processed 
  10.1 Barbaro Bersagli s.a.s., as required by the EU Regulation on privacy, expresses its legitimate interest in the processing of personal data pursuant to art. 24 privacy code.
More specifically, such processing will be carried out only for ordinary administrative, accounting and tax purposes.
In particular, it is specified that the collected data will be used only for:
  1. fulfill a legal obligation, a regulation or Community legislation (Article 24, letter a);
  2. to perform obligations arising from the contract of which the interested party is a member;
  3. to fulfill, before the conclusion of the contract, specific requests of the interested party (Article 24 letter b).
